Terms and conditions for 12 Classes per 4wkCycle

This membership is for a 4 week billing cycle and allows member access to the CrossFit group classes 12 times within that time. Unused classes do NOT roll over to the next billing cycle. Any class attendance above and beyond 12 classes within that given billing cycle will be automatically charged at $25/class. There are no refunds on this membership.



Cancellation Policy: If you decide to reactivate your membership in the future (and we hope you do) membership rates in effect at the time of reactivation will be applicable as membership rates are subject to change. Since your agreement is a 4-week cycle, we just require 21 days advance notice via https://crossfittorque.com/cancellation/ (email, Facebook messages, text messages, and in-person requests do not count) to terminate your account. This will serve as your 21-day written cancellation notice as required by your membership agreement. Your membership will be cancelled 21 days from the submission of the form below.

If you will be absent from CrossFit Torque for more than 10 days, you may request that your membership be placed on hold for circumstances such as injury, illness, work-required travel, and job loss. You may be required to show proof of the hold-request circumstances satisfactory to CrossFit Torque. You must provide such proof, if requested, to CrossFit Torque no later than three business days before your next billing date to avoid being charged (only valid via submission using this link). This is a complimentary service we offer. This can only be requested twice a year; membership holds will be granted at the sole discretion of CrossFit Torque. The minimum hold is 10 days with a maximum of 56 days.

Placing your membership on hold means that you will not have access to CrossFit Torque for the duration of the hold and you will not be billed for the duration of the hold. Any request exceeding 56 days will be treated as a cancellation request with a $99 fee associated. Your Assigned Commitment will be suspended for the duration of the hold and will resume when the hold terminates. Please mark your calendars as we will not issue refunds or unused portions of your membership. Please note, there are no holds during -or leading up to- the month of December.

Congratulations on joining the best health and fitness community in the area! Today is the day you begin the journey towards being the best version of yourself. You might be finishing up our Torque Way On-Ramp Sessions (personal training, knowledge and hands-on learning), joining Personal Training, or maybe you’re joining us from another affiliate. Most importantly you are on the right path to a healthier and more fit life. Our goal is for CrossFit Torque to become a second home to you; we want this to be the best hour of your day! Our Mission at Torque is to create a community of Education & Support with the goals of: removing limitations, expanding our abilities, and balancing fitness & health!

In order to have a successful relationship, we have all members read and agree to the below. Please read this carefully! It contains important information about your membership with us that you agree to upon joining. We wrote it in plain English first and fancy legalese after, which you certainly don’t have to read but are responsible for understanding!

  1. Please do these things:

    • Sign into your Pike13 account and create a profile. Here you are able to update your payment method, see past and future bills, register for classes, and see our class schedule. https://crossfittorque.pike13.com and create a password. Immediately after logging in, it will prompt you to agree to your terms and conditions. Sign and check where needed. Click finish.

    • Request access to our private, members only Facebook group. This is the easiest (and quickest) way to keep up with important announcements as well as upcoming events. It is the one we recommend most. Plus it’s another great way to connect with your fellow TorqueNation members: www.facebook.com/groups/crossfittorque

    • Visit crossfittorque.com to learn more about upcoming specialty series, check out our blog, and sign up for our newsletter!

  2. Re-acknowledge these things that you already acknowledged and signed! Especially the cancellation policy. Ask if you are unclear about this in any way.

    • Your 4-week membership or Personal Training fee does not include Massachusetts sales tax.

    • You are responsible for ensuring your credit card remains up to date in Pike13. Repeated failed attempts to charge your card may result in a failed payment fee.

    • If you are a cash / check client, please pay on or before your due date, and provide a credit card to have on file.

    • Account renewal policy: your contract is on a 4-week billing cycle from the day you sign up. If you want to stop your recurring payment, you must request to cancel in writing via email a minimum of at least 21 days in advance of your next scheduled payment (further details about account cancellation is below), otherwise your account is subject to a cancellation fee.

    • Membership Prices will automatically increase annually by 2-5% every April 1st.

    • Injuries / Life Stuff: We want fitness to become a sustainable part of your life. We aren’t doctors or physical therapists, but are great a modifying workouts to fit your needs regardless of what’s going on with your body. If you ever experience illness or injury or need to modify your workout for any reason, you NEED to keep us informed so we can make sure you’re safe in classes. Please communicate with us via email so we can work with you.

    • Once more, with feeling! You understand that your coaches will check in and are here to help modify workouts for any needs that you may have, but ultimately, it’s up to you to make use of your membership. You promise to reach out if you need support, guidance, accountability, or help with modifications. You pledge to simply get in the door and do your best on any given day. You understand that your communicating about membership needs is your responsibility - CrossFit Torque cannot process refunds for unused portions of your membership if you suspend your membership and fail to email to extend your suspension or return to the gym.

Here’s some random stuff that didn’t fit anywhere else!


You are about to start on a great adventure! You have entered into a fun supportive community. Each and every one of us is now an athlete, on our journey to a healthier lifestyle. Below are a few suggestions and requests we have to make your experience and others more enjoyable, and to also reap the most benefits out of CrossFit Torque and your coaches.

  • You Agree to be a Kind person
    You agree to keep and obey all rules, regulations, and policies now in force or in the future prescribed by CrossFit Torque, for the use of CrossFit Torque training facilities, premises, and equipment therein, and CrossFit Torque reserves the right to revoke this Membership for cause if you fail to keep and obey any of such rules and regulations, or for reasons of nuisance, disturbance of other members or staff, moral turpitude (lol) or fraud. Without limiting your obligation to obey the rules and regulations of CrossFit Torque presently in force or in the future prescribed, you agree to obey the policies and on the HOUSE RULES form as described on the “Policies” page of the CrossFit Torque website.

  • CrossFit Torque can cancel this contract agreement at any time. If CrossFit Torque terminates your contract agreement prior to the end of your paid month, we will refund you for unused future services.

  • Without limiting CrossFit Torque’s ability to terminate this Membership for cause, CrossFit Torque may terminate this Membership for any reason at the end of any given pay period. If CrossFit Torque elects to so terminate, CrossFit Torque will refund a pro rata portion of any dues applicable to future month(s).

  • This Membership belongs to you; you can’t give it to anyone else. It is expressly understood and agreed that this Agreement is not assignable or transferable by CrossFit Torque members and no rights or privileges granted by this Membership can be transferred or assigned by a CrossFit Torque member.

  • Say cheese! We can take your photo! Any pictures, audio, or visual recordings taken of you at CrossFit Torque or at Torque events can be used for publication, promotion, articles, shows and advertisement without additional consent and without compensation.

  • Be an active member of the community

  • Cubby Room: use the cubby area for all keys, waters, jackets, bags, phones, etc - only notebooks should be out on the gym floor, nothing else.

  • Changing rooms: there are two changing rooms located near the bathrooms - please use these to change before or after class - leave the bathrooms for you know what, and the offices for office work.

  • Children during classes: Please do not bring your children to Torque, even if they are old enough to sit on the chairs alone. In order to create and maintain the CrossFit workout environment our clients have signed on to and expect, this needs to be recognized and abided by. We would like to say that children are more than welcome to all family events at CFT. We have worked hard since opening in December 2010 to create a CFT community that is inclusive of everyone and will continue to strive for this going forward. Your understanding and cooperation regarding this decision would be greatly appreciated.

  • Jump Ropes: please bring your own Jump Rope to class; everything else is provided


Please Don’t Sue Us (Liability Waiver) You are working on your health and hotness at your own risk. It is further agreed that all exercises including the use of weights, number of repetitions, and use of any and all machinery, equipment and apparatus designed for exercising and the use of CrossFit Torque premises and facilities shall be at your own risk. Notwithstanding any consultation on exercise which may be provided by CrossFit Torque employees or agents. It is hereby understood that the selection of exercise programs, methods and types of equipment shall be your entire responsibility, and CrossFit Torque shall not be liable to you or your family for any claims, demands, injuries, damages, or actions arising due to injury to your person or property arising out of or in connection with the use by You of the services and facilities of CrossFit Torque or the premises where the same is located.

You must tell us immediately if anything feels less than stellar during a coached session or class, and if anything happens to you health-wise outside of the gym that will help us be better coaches, please let us know. If you become pregnant, please inform us as soon as you know (we will keep it under wraps until you make it public) so we can ensure your safety in training sessions.

CrossFit Torque can’t be responsible for your stuff, so leave the diamonds at home. If you bring any personal property onto the premises of CrossFit Torque, you take such action at your sole risk. You hereby hold CrossFit Torque, its successors, assigns, owners, officers, directors, employees, and agents harmless from all claims which may be brought against them by You, on Your behalf, by Your family, and Your executors, administrators, and personal representatives for any such injuries or claims aforesaid and You for Yourself and on behalf of Your family, executors, administrators, and personal representatives does hereby forever release and discharge CrossFit Torque, its successors, assigns, owners, officers, directors, employees, and agents from all claims, demands, injuries, damages, actions, losses and expenses. This section will survive any cancellation of this Agreement.



MEMBERSHIP CONTRACT AGREEMENT

“Member,” “you” or “your” mean the person signing the CrossFit Torque, LLP., d/b/a/ CrossFit Torque Membership Contract (hereinafter “Agreement”). “CrossFit Torque” means CrossFit Torque, LLP., doing business as CrossFit Torque. By signing this agreement, I (the “client” and undersigned”) understand that I will be entering into a legally enforceable agreement with CrossFit Torque as follows: Please enroll me in the program I have selected, and, subject to CrossFit Torque’s guarantee; I agree to pay your fees as indicated. CrossFit Torque reserves the right to institute a cost of living increase on the membership fees annually without written notice to you (ranging from 1-5%). I understand that the terms and conditions of this Agreement will govern all aspects of my participation in each Class I take and fee arrangements I elect to make. I also agree to comply with the policies and procedures that you and your instructors may from time-to-time communicate to me. %%AGREE_CHECKBOX%%

BASIC TERMS %%AGREE_CHECKBOX%%

Your “Assigned Commitment” is the four-week (28-day) commitment, training package, punch card, seminar, course, or any other plan or pass you just selected in the online customer management software, or in person at the facility. Your Assigned Commitment is good for the duration that the membership is active. This membership is only good at CrossFit Torque, located at or around 127 Washington Street, Foxboro, MA 02035.

Your Assigned Commitment allows you to participate in the Assigned Commitment’s class or course offered at CrossFit Torque. It does not grant you access to any class, seminar or specialty class outside the scope of this Assigned Commitment that CrossFit Torque may offer.

After your Assigned Commitment is complete, your membership will auto-renew automatically with a new commitment of the same type and duration. After your Assigned Commitment is complete, should you choose to cancel your membership, you must notify CrossFit Torque by email to amanda@crossfittorque.com 21 days before your Assigned Commitment renewal date. If, after you agree to your Assigned Commitment, you wish to lengthen your commitment, you may do so. A new commitment requires a new contract.

CrossFit Torque Membership Hold Policy %%AGREE_CHECKBOX%%

CrossFit Torque Cancellation Policy %%AGREE_CHECKBOX%%

You may cancel the remainder of your Assigned Commitment by notifying CrossFit Torque by email to admin@crossfittorque.com with a 21-day early cancellation policy. You may cancel the remainder of your Assigned Commitment without penalty if you move more than 20 miles from CrossFit Torque. You must show proof of the move satisfactory to CrossFit Torque (for example, by a lease, utility bill, title to a house, or military orders). Should you choose to cancel your membership, you must notify CrossFit Torque by email to admin@crossfittorque.com 21 days before your Assigned Commitment renewal date. If you cancel your membership for any reason, you lose all rights and benefits associated with your Assigned Commitment, including the price of your monthly payment. Your membership will be cancelled 21 days from the submission of the form below. Note that if you have a scheduled payment within this period, the payment will be processed as scheduled. In some situations, a $99 cancellation fee may be applied and your account may be closed on the same day. All payments are non-refundable.

Billing Information and Failed Payments %%AGREE_CHECKBOX%%

If your billing information is becoming or becomes invalid (for example, your credit card is expiring or you cancel the card number you entered initially), you must promptly update your billing information in Pike13 at least five days before your next billing date.

If the billing information (for example, ACH withdrawal information or credit card number) you entered is incorrect or becomes incorrect and your monthly payment fails, CrossFit Torque will notify you of such failure by email. If you do not correct your billing information within five calendar days of the emailed notice, you will be charged $50 for the first failed monthly payment. You will be charged $100 for each failed monthly payment after your first notice of a failed monthly payment. You will remain liable for your monthly membership payment in addition to these fees. CrossFit Torque may change membership terms and rates under this agreement by posting notice of such change at least 21 days in advance of such change.

Notice for Collections

CrossFit Torque reserves the right to send any membership, commitment, fees, or any contracted purchase to collections if the account is 21 days past due. CrossFit Torque will contact the member once via email to resolve the payment issue. If the member does not promptly pay the amount owed, the total amount due for the member’s remaining Assigned Commitment plus any additional fees may be sent to a collection agency for collection. If such action is necessary, you agree to pay all costs incurred by CrossFit Torque for collection, including reasonable attorneys’ fees.

By accepting these terms and beginning to attend classes you certify that you understand and acknowledge everything outlined above. You are not under the influence of any drugs, alcohol, or other intoxicants. You are not suffering from any illness or incapacity.
